A trademark is a distinctive word, name, symbol, or similar identifier used to set apart the goods or services of one seller or provider from those offered by others in the market. It also signifies the origin of the associated products or services.

The TM symbol represents an unregistered trademark, signifying that the mark is distinguishable from other products or services. Under the Trademark Act, an unregistered trademark doesn’t receive full legal protection and does not stop others from using the same or similar mark.

Trademark classification is the process where examiners and trademark attorneys organize the necessary paperwork, including applications for trademarks and service marks, based on the types of goods or services that the marks apply to.

Submitting a trademark application typically requires a time frame of 18 to 24 months.

To file a trademark, the following documents are needed:

  • A copy of the logo (optional)
  • Signed Form-48
  • Certificate of Incorporation or Partnership Agreement
  • Proof of identity of the signatory
  • Proof of address of the applicant

After your trademark application is approved, you’ll receive an acknowledgment that grants you the right to display the TM symbol. Once the registration process is complete, you can begin using the ® symbol.
